Article 17 – Legal warranties owed by the Vendor
The Vendor guarantees goods against defects in conformity in accordance with articles L.211-4 et seq. of the French Consumer Code. These provisions do not exclude the Buyer’s right to bring an action resulting from redhibitory defects, in accordance with articles 1641 to 1649 of the French Civil Code, subject to proof of the hidden defect.
The Seller is liable for defects of conformity and latent defects, in accordance with the law. The Buyer benefits from the following provisions:
– Article L 211-4 of the French Consumer Code: The Vendor must deliver goods in conformity with the contract and be liable for defects in conformity present at the time of delivery, as well as for defects resulting from packaging, assembly instructions or installation when the latter is under his responsibility.
– Article L 211-5 of the French Consumer Code: To be in conformity, the good must :
1. Be fit for the use usually expected of similar goods and, where applicable, correspond to the description given by the Seller and possess the qualities presented by the latter;
2. Present the qualities that a Buyer may legitimately expect in view of the public statements made by the Seller, the producer or their representative.
– Article L 211-12 of the French Consumer Code: Any action resulting from a lack of conformity must be brought within two years of delivery of the goods.
– Article 1641 of the French Civil Code: The Vendor guarantees against hidden defects which render the goods unfit for their intended use, or so diminish this use that the Purchaser would not have purchased them, or would have paid a lower price for them, had he been aware of them.
– Article 1648 al 1 of the French Civil Code: The action resulting from redhibitory defects must be brought by the Buyer within two years of the discovery of the defect.
In accordance with article L 211.16 of the French Consumer Code, any repair covered by the warranty and immobilizing the equipment for more than seven days extends the duration of the initial contractual warranty.
Article 18 – Commercial warranty provided by manufacturers
In addition to the legal warranties provided by the Vendor, certain products sold may benefit from a commercial warranty offered by the manufacturer. The scope and duration of this warranty vary according to product and brand. This commercial warranty is assumed directly by the manufacturer and not by the Vendor. Consequently, the Buyer is encouraged to carefully consult the instruction manual supplied with the products, as well as the specific conditions of the manufacturer’s warranty. This information is available in the manual or on the manufacturer’s website. To benefit from this commercial warranty, the Buyer must contact the manufacturer directly, not the Vendor. The Vendor cannot be held responsible if the manufacturer refuses to apply the warranty.
To benefit from the commercial warranty, it is imperative to keep the purchase invoice, the original packaging and all product accessories.
If the original packaging is missing, the Vendor cannot be held responsible for any breakage due to transport, and repackaging costs may be invoiced.
Warranty exclusions are those specified in the manufacturer’s contractual warranty conditions.
No exchange will be granted for products returned incomplete (instructions, accessories, etc.), without their original packaging or with damaged packaging. Products must be returned with the invoice.
Article 19 – Environment
For any purchase of a new product subject to the provisions of the decree of July 20, 2005 (WEEE regulation), the customer can deposit the old product of the same category in the premises of entrepot-electro.com or in the selective collection points set up by the municipalities for the treatment of waste electrical and electronic equipment, or in the local waste collection centers.
Article 20 – Applicable law – Disputes
These General Terms and Conditions and the relationship between the CLIENT and the SELLER are governed by applicable law.
In the event of a dispute, only the competent courts will be designated.
However, before resorting to an arbitral or state judge, negotiation will be privileged in a spirit of loyalty and good faith in order to reach an amicable agreement in the event of a dispute relating to the present contract, including its validity.
The party wishing to initiate the negotiation process must inform the other party by registered letter with acknowledgement of receipt, specifying the elements of the dispute. If the parties fail to reach agreement within fifteen (15) days, the dispute will be submitted to the competent court.
Throughout the negotiation process and until its conclusion, the parties undertake to refrain from taking legal action against each other in respect of the dispute in question. By way of exception, the parties may bring the matter before a court of summary jurisdiction or apply for an injunction. Such action does not entail waiver of the amicable settlement clause, unless expressly agreed otherwise.
